Project Description: Glacier Northwest, Inc. (dba CalPortland) proposes dredging at the ready-mix plant and aggregate yard located at the north end of Lake Washington at 6431 NE 175th Street, Kenmore, WA 98028. There are Shoreline Substantial Development Exemption (SSDX23-0025) and SEPA (SEPA23-0027) applications associated with the project. The project proposes to remove approximately 800 cubic yards of material within the previously maintained 16,000-square-foot berth area as a maintenance dredging action. The project is proposed as maintenance to provide safe access for vessels and barges to the terminal by removing (dredging) sand, gravel, and small amounts of sediment.
Project Status: The SEPA Determination of Mitigated NonSignificance (MDNS) was issued on June 3, 2024 and includes mitigation measures (conditions). Notices were sent to Parties of Interest (POIs) via email and USPS mail (if the POI provided their address), posted on site, posted on the website, and uploaded to the SEPA registrar.
This project is subject to additional State and Federal permit requirements.
- Testing: The City’s SEPA MDNS decision requires sediment testing consistent with the Dredged Material Evaluation and Disposal Procedures (DMMP) User Manual including but not limited to testing for heavy metals, dioxins, PCBs, and arsenic. A complete list of tested Chemicals of Concern (COCs) is provided in Table 8-3 of the DMMP User Manual.
- Testing Results: Washington State Department of Ecology (“Ecology”) evaluates dredged material using the guidelines set forth in the DMMP User Manual. Ecology is responsible for ensuring that DMMP actions and decisions comply with state regulations including the Washington State Sediment Management Standards (SMS) and Washington State Water Quality Standards. The City’s SEPA MDNS requires that test results be made available to the public. Once available, results will be posted on the City's website and Ecology's EIM Database.
The SEPA MDNS determination was appealed on 6/17/2024. A copy of the Statement of Appeal was forwarded to the Applicant and Hearing Examiner.
- A virtual pre-hearing conference was held on 7/18/2024 at 1:00 p.m. A copy of the Hearing Examiner's Pre-Hearing Order was provided to all parties of record and all parties of interest. The public were invited to attend the pre-hearing conference (the pre-hearing conference did not include public comment).
- On 7/23/2024, the Hearing Examiner notified the City, Applicant, and Appellant that he plans to issue an Order of Dismissal based on lack of jurisdiction under the Kenmore Municipal Code. When issued, a copy of the order will be posted online and notification will be provided to parties of interest.
- On 7/25/2024, the City mailed a Notice of Cancelled Hearing to parties of record, parties of interest, and property owners within 1,000 feet of the property.
- On 8/15/2024, the Hearing Examiner issued a Decision on the appeal. The appeal was dismissed. As governed by the Washington State Land Use Petition Act, Chapter 36.70C RCW, the parties have 21 days to file and serve an appeal with King County Superior Court and all required parties.

Transparency and Public Engagement:
In June 2023, the City mailed notices to property owners located within 1,000 feet of the site, posted the notice on our website, and published it in the Seattle Times newspaper. The notice was also posted on a large white land use notice board on site. The public comment period was June 10, 2023 – July 1, 2023.
Based on feedback provided by the community, CalPortland hosted a virtual community meeting on Monday, February 12, 2024. The City mailed notices to property owners within 1,000 feet of the site and Parties of Interest (POIs), advising them of the date, time, and location of the informational public meeting (the notice was also posted on our website). This meeting was not required by City code. The applicant voluntarily hosted this meeting to help address concerns raised during public comment and provide information to the public. The meeting provided Kenmore residents with the opportunity to learn more about the project and ask questions of the applicant, the City, and other reviewing agencies including the Department of Ecology, US Army Corps of Engineers, and Department of Fish & Wildlife. On May 31, 2024, the City sent the SEPA MDNS Notice of Decision to POIs. A copy of the notice is provided above under "6/3/2024: Shoreline and SEPA Decision." The notice includes the list of SEPA conditions and how to appeal the City's decision.
Public Comment: The public comment period for the project is closed (it was open June 10, 2023 – July 1, 2023). Below are the comments received from the public during the 21-day public comment period along with the applicant's response.
